The Personal Data Protection Commission (PDPC) of Tanzania has now opened the registration for all Data Collectors and Controllers, aligning with the Personal Data Protection Act No. 11 of 2022, Section 14(1). Entities are required to register within six months as stipulated by the PDPC.
For clarification:
1. A “data processor” is defined as an individual, legal entity, or governmental body that handles personal data under the directive and on behalf of a data controller, except for individuals who are granted permission to process the data by the data controller themselves. This term also encompasses the designated representatives of the data processor.
2. A “data controller” is an individual, legal entity, or public authority that either individually or in partnership with others, sets the objectives and how personal data is processed. In instances where legislation specifies the objectives and the method of data processing, the “data controller” is the individual, legal entity, or public authority that is appointed to be responsible by such legislation, including any representatives thereof.
